Benjamin C. Rosen, Esq., is admitted to practice law in Washington state (1997) and throughout Mexico (2010)¹. Mr. Rosen is a rare breed of American educated attorneys who have passed the bar in both the United States and Mexico.

Ben’s practice focuses on cross-border transactions, real estate law and development, hotel, resort & hospitality law, corporate and finance. As a Mexican and American attorney, Ben is able to structure transactions and draft legal documents governed by laws of both countries, seamlessly.

Since settling in Mexico in 1997, Ben—a dual American and Mexican citizen—has served as a bridge linking businesses, investors and entrepreneurs from one country to the other.  Ben now shares time between Rosen Law’s offices in Los Cabos and Newport Beach.

From 2005 - 2010, Ben has counseled foreign investors and lenders in transactions representing more than a combined US$320 million in Mexican real estate.

Ben is a frequent speaker and commentator before international legal and business audiences on Mexican matters. In September 2010, Ben spoke on the “the Mexican Real Estate Market” at the Baja Investment Forum in Los Angeles, California and in March 2010, Ben delivered the Keynote Address at the Mexico Living Seminar in Vancouver, Canada. In October 2007, May 2007, December 2006 and April 2006, Ben co-chaired and/or spoke at the Atlas conferences held in Mexico and the United States entitled on “Legal Strategies for Doing Business in Mexico”/”Mexico Real Estate Summit”. In July 2006, he spoke at the International Living Seminar in San Miguel de Allende, Guanajuato, and in October 2006 and October 2005, at the Baja California Meeting Point in Tijuana. In 2005, Ben spoke on Mexican real estate, foreign investment and international law topics at conferences in San Miguel de Allende, Guadalajara, La Paz, New York City, Seattle, Vancouver, and Amsterdam. In 2004, Ben lectured before multiple trade delegations organized by the Canadian Embassy in Mexico and a CLE sponsored by Seattle University Law, on the Mexican legal culture and system. In 2003, Ben lectured on U.S. and cross-border environmental law at the Autonomous University of Mexico (UAM) Doctoral Program in Environmental Law.  He has also been quoted in articles on Mexican and NAFTA issues, in prestigious publications in the United States, Canada, and Mexico.

During his nine years in Mexico City, Ben was a longstanding member of the American and Canadian Chambers of Commerce, holding leadership positions before moving to Los Cabos in 2005. Ben is now a member of the American Bar Association and the US-Mexico Chamber of Commerce.

He has authored articles published in various international business and legal media on topics such as foreclosing on cross-border loans in Mexico; U.S.-Mexico cross-border environmental and energy law; international letters rogatory; enforcing foreign judgments in Mexico; privatization of Mexico’s airport and oil and gas sectors; the Mexican foreign investment law; Mexico’s maquiladora (in-bond plant) program; and government bidding procedures.

From 2003 to 2006, Ben was member of a recognized Mexico City law firm, where he finished his tenure as Managing Partner, Los Cabos office. From 1997 to 2004, in addition to his law practice, Ben was an adjunct law professor at the Universidad de la Americas (UDLA) School of Law in Mexico City, where he taught United States Judicial System and Civil Procedure, and Legal Writing.

In 2001, Ben co-founded the international business and project development firm, AmeriCompass, based in Mexico City, developing energy, environmental and import-export projects and opportunities for US and Canadian clients. From 1999-2001, Ben served as General Counsel and Manager, Mexico City, of a Canadian-owned international business consulting group and its subsidiary project development companies. From 1997-1999, Ben was a foreign law associate at Goodrich, Riquelme in Mexico City, where he counseled companies on international business transactions, joint venturing, mergers & acquisitions, and government contracting. While in law school, Ben clerked for various public defender agencies and successfully tried and won several jury trials.

Ben is happily married, and has three young girls born in Mexico. He enjoys playing tennis, basketball, and following Mexican politics. He holds a Bachelor of Arts in Political Science with a minor in English from the University of Oregon (1992). He earned his Juris Doctor degree, awarded cum laude, from Seattle University (1996), where he authored an independent study on international business transactions between the United States and Mexico. Ben earned his Mexican Law degree from the Centro Nacional de Evaluación para la Educación Superior (CENEVAL) (2009).
