- Mexican Immigration Department Enacts Amnesty Program Granting FM-2s to Foreigners Residing in Mexico without Visas:
Rosen Law is pleased to inform you that the “2008 Immigration Regularization Program” has been approved by the Mexican Immigration Institute. All foreigners—regardless of nationality--will be eligible for amnesty under the program if they currently have an irregular immigration status in Mexico (e.g., one who is residing in Mexico with an expired FM3 or Tourist Visa or without any visa at all) and meet the criteria below. Once granted, the foreigner will be issued an FM-2 (residency status) with authorization to live in and/or work in Mexico. An FM-2 is issued even if the foreigner never had an FM-3, which is a significant departure from current immigration practices in Los Cabos and across Mexico.
The eligibility criteria are as follows. The foreigner must:
- have entered Mexico on or before December 31, 2006 and remained in the country until the amnesty application is granted, and
- have, and be able to evidence with the appropriate documentation and 2 witnesses the existence of:
a. a job (or job offer) in Mexico; or
b. a Mexican relative (spouse or common-law spouse, parent or child); or
c. a foreign relative (spouse or common-law spouse, parent or child) that has valid immigration document;
- have a valid passport
- pay a possible fine imposed by the Immigration Institute, which may range between US$100 and US$500 maximum.
This program is a significant breakthrough for immigrants’ rights advocates. Indeed, the established criteria are broader than those of former programs (many of which included only select nationalities), the estimated resolution time has been reduced to around 2 months, and, in general, applications meeting the above criteria can only be denied in extreme cases (e.g., if the foreigner has been convicted or is being prosecuted for a crime or has committed a severe immigration violation). In addition, as an added incentive for foreigners to apply, the program expressly prohibits immigration officials from detaining and or attempting to deport any foreigner who approaches the Authorities to regularize his/her immigration status in Mexico.
The Program entered into effect on November 12, 2008, and will remain in force until May 11, 2011.

- Mexican Immigration Dept Implements System to Track Immigration Status and Entry of Foreigners:
Recently, Rosen Law has been advised that the Mexican Immigration Department has updated its methods to verify the immigration status of foreigners entering Mexico by plane. Under the new and improved system, the Immigration Officer will type the name of each person entering the country into a computer in able to locate his/her immigration file in a database, allowing the Officer to view in real time, among other data, whether the foreigner has a restriction on entering the Country, a pending procedure or citation, or even the status, number and type of the authorized FM-3 or FM-2 of the visitor (if any).
Therefore, please be aware that if you mistakenly attempt enter the country with a tourist visa instead of by presenting your FM-3/FM-2, it is quite possible that under the new system, the Immigration Officer will detect the mistake, and that if detected, you could face the imposition of a fine, your FM-3 could be revoked, and you could be deported or potentially even arrested.
Accordingly, to avoid a possible uncomfortable situation, Rosen Law strongly advises that you remember to always travel and enter the country with your FM-3 in hand, and procure that the Immigration Officer stamps all entries and departures in both your FM-3 and passport. If you happen to be subjected to an immigration revision upon entry, or at any other time, please always remember to 1) remain calm; 2) contact us immediately; 3) cooperate with the Immigration Officer as soon as a translator of your full confidence is present; and 4) do not lie to the Immigration Officer, but rather explain them that it was a simple mistake.
